The truck was carrying over twenty tons of BudLight when a compact size sedan crashed into it causing the truck to overturn and hit a nearby tree. The arbitrator have found 100% liability against the original defendant, the operator of the sedan, whom the Plaintiff already secured a $25,000.00 full policy tender. Thus, the matter proceeded to arbitration pursuant to the Supplemental Coverage provisions of the insurance policy maintained by the truck owners. Plaintiff sustained a left-shoulder fracture of the clavicle bone with superior displacement, as well as five rib fractures on the left, and a tear the left shoulder rotator cuff tendon, requiring surgery.
