In a matter recently tried before Arbitrator Nancy Hughes at the Nyack office of the American Arbitration Association, Mr. Levitsky obtained a $225, 000.00 award on behalf of the operator of a commercial truck involved in a two-car collision that occurred on the Long Island Expressway a little over a year ago. The truck was carrying over twenty tons of BudLight when a compact size sedan crashed into it causing the truck to overturn and hit a nearby tree. The arbitrator have found 100% liability against the original defendant, the operator of the sedan, whom the Plaintiff already secured a $25,000.00 full policy tender. Thus, the matter proceeded to arbitration pursuant to the Supplemental Coverage provisions of the insurance policy maintained by the truck owners. Plaintiff sustained a left-shoulder fracture of the clavicle bone with superior displacement, as well as five rib fractures on the left, and a tear the left shoulder rotator cuff tendon, requiring surgery. After a convincing opening statement by Plaintiff’s counsel, followed by a three-hour direct and cross-examination of the Plaintiff, the arbitrator remained unmoved by defense counsel’s arguments, rendering an substantial award in the Plaintiff’s favor.
